THE CITIZENS’ ACCESS TO SETTLING THE LABOUR LAW DISPUTES IN THE UKRAINIAN LAW. THE ANALYSIS
Abstract
According to the Article 43 of the Constitution of Ukraine, everyone has the right to work. That includes the ability of supporting yourself by working, and choosing the occupation freely. The state is obliged to provide the conditions allowing the citizens to work and, moreover, to guarantee the possibilities of opting for a particular profession. The rights: to work in safe conditions, to get paid a basic salary, to rest and to social welfare – all of them are ensured by the Constitution of Ukraine. Nevertheless, there are also citizens’
freedoms, e.g. creating workers’ unions, striking, and other legal ways to protect employees’ rights, including acting by the course of the law. Realising the right to work in proper conditions and other workers’ rights may cause conflicts between employees and employer.
